휴대폰은 개인에 대하여 사적인 정보를 방대한 양으로 담고 있기 때문에 이를 압수수색할 경우 수사에 결정적인 역할을 수행한다. 이 때문에 휴대폰 압수수색에서 영장주의 원칙을 놓고 많은 논쟁이 제기되고 있다. 최근 대법원 판결에서는 현행범의 체포에서 휴대폰을 영장 없이도 압수수색할 수 있다고 하였으나 방대한 양의 개인정보를 담은 휴대폰의 압수수색에서 영장주의의 예외를 인정할 경우 개인의 권리가 지나치게 침해되고 방어권이 무력화될 수 있다. 미국의 판결 Riley v. California에서 미 연방대법원은 휴대폰의 압수수색에서 영장주의의 예외의 적용을 부정하면서 영장주의 원칙을 따라야함을 재확인한 바 있다. 각각의 판결의 논증을 토대로 이 연구에서는 휴대폰 압수수색에서 영장주의 예외 법리의 적용을 지양하여야 할 것을 주장하고 있다. 현행범 체포시의 영장 없는 압수수색은 형사소송법상의 문언에 별다른 제한 조건 없이 포괄적인 대물적 강제처분을 인정하고 있기 때문에 영장주의 정신에 위배되어 권리 침해의 가능성이 큰 휴대폰의 영장 없는 압수수색에 적용할 수 없다는 점, 또한 디지털 압수수색 절차상 관련성 규정과 참여권 규정이 규정되어 있으나 이러한 제한만으로 휴대폰에 대한 영장 없는 압수수색이 합리적으로 제한되리라고 기대하기 어렵다는 점, 압수수색의 대상으로서 휴대용 정보저장매체는 전통적인 공간적 한계를 벗어나기 때문에 보다 특별한 보호의 대상이 되어야하고 엄격한 영장주의의 해석이 요청되는 영역이라는 점을 바탕으로 휴대폰 압수수색의 법리에서 엄격한 영장주의의 해석이 요청됨을 주장하고 있다.
Cell phone is a container for a large quantity of privacy information. When law enforcement officer does search and seizure of cell phone, it would be critical for the criminal investigation. A controversy has risen about whether to apply the warrant requirement to the cell phone search and seizure. Recently, the Korea Supreme court held that when the criminal was arrested in the act, the officer is able to search and seizure without warrant. When it comes to cell phone search and seizure, the warrant requirement exception would violate the person's rights and privacy. In Riley v. California, the U.S. Supreme court forbid the warrantless searches exception of cell phones. The court held that the search incident to arrest exception would not apply to the cell phone search cases because it did not meed the requirement of the exception. Also, the Court held that searching a cell phone is like giving police authority to search through the private papers and drawers and cabinets of somebody's house. The warrantless cell phone search and seizure without limitation is saving flawed search warrant by the exceptions. Considering the fact that cell phone carry an enormous amount of personal data and the police officers have significant influence over the arrest and search and seizure process, strict interpretation for the warrant system should be required for the cell phone search and seizure.
