조서는 수사과정에서 작성되고, 재판과정에서 평가된다. 따라서 작성국면과 평가국면을 고르게 탐구해야 바람직한 개선방안을 마련할 수 있다. 하지만 조서제도 개선에 관한 논의는 재판과정에서의 평가, 즉 증거능력에 관한 것이 상대적으로 더 많다. 본고는 조서의 작성국면에 관한 선행연구와 평가국면에 관한 이론을 종합하고, 이를 바탕으로 일반인과 변호사의 인식을 조사하여 조서왜곡이라는 작성국면의 문제와 증거능력이라는 평가국면의 문제를 연계해 보고자 하였다. 연구 결과, 일반인은 변호사보다 조서왜곡이 증거평가에 더 큰 영향을 미칠 것으로 인식한다는 점, 일반인과 변호사 공히 진술의 생략보다 조작이 증거평가에 더 큰 영향을 미칠 것으로 인식한다는 점, 변호사는 조서왜곡이 증거능력보다 증명력 평가에 더 큰 영향을 미칠 것으로 인식한다는 점, 변호사는 조서왜곡이 주로 실질적 진정성립과 연관되지만 다른 요건들과도 연관될 것으로 인식한다는 점 등을 알 수 있었다. 결론에서는 연구의 의의와 제약점을 서술하였다.


In Korea statements of a suspect should be recorded in paper-type interrogation record form. Interrogation records of suspects are admissible in criminal courts under certain conditions set by Korean Criminal Procedure Law. However, there has been constant criticism that there are distortions in the interrogation records of the suspect’s statements. Interrogation records are written in the process of investigation, but the records are evaluated in the course of trial. So not only trial phase, but also investigation phase should be explored evenly in order to improve the interrogation record system. But discussions abut the interrogation record system were mainly focused on evaluation in the course of the trail. In this study, we synthesized both the preceding studies of the investigation phase in which the interrogation records of the suspect’s statements are written and the theories on the evaluation of the records during the trial. Then, targeting ordinary persons and lawyers we carried out a survey on the issue of distortion of interrogation records(investigation phase) and the issue of legal evaluation of the records(trial phase). Finally, the two issues were analysed in conjunction with each other from a empirical and legal point of view. The results showed that, (1) Ordinary persons have a tendency to rate higher the effects of distortion of interrogation records than lawyers. (2) Both ordinary persons and lawyers have a tendency to rate higher the effects of the fabrications of a suspect’s statement than the omissions of a suspect’s statement. (3) Lawyers tend to believe that the distortions of the interrogation records have a stronger effect on weight of evidence than admissibility of evidence. (4) Lawyers tend to think the distortions are in relation with not only authenticity, but also other elements of admissibility of evidence. The results of this study could help to link the legal perspectives and empirical studies. And this study will provide useful informations to the persons who engaged in lawmaking. However, the results of this study should not be over-generated or conclusively cited, considering that it is a survey conducted on a relatively small number of samples.
