이 글은 대법원 2019. 11. 21. 선고 2015두49474 전원합의체 판결에 대한 비판적인 평석이다. 방송의 공정성과 공공성 심의대상 프로그램은 보도 프로그램에 한정되지 않고, 매체별, 채널별, 프로그램별 특성을 고려한 방송심의가 필요하며, 교양 프로그램의 경우 보도 프로그램에 비해 객관성·공정성·균형성 심사기준을 완화하는 것이 타당하다. 여기서 완화된 심사기준은 방송심의에 관한 규정 위반 여부가 아닌 제재조치의 수위와 관련이 있다. 이 사건 각 방송의 내용을 고려할 때, 시청자 제작의 역사 다큐멘터리 프로그램이라는 이유로 객관성·공정성·균형성 유지의무를 위반하지 아니하였다고 판단한 다수의견은 내적 다원주의를 채택한 현행 방송법하에서 방송사업자의 공정성·균형성·객관성 준수의무를 방송사업자의 표현의 자유에 비해 경시하였다는 점에서 문제가 있다. 또한 다수의견이 이 사건 각 방송이 사자 명예존중을 규정한 심의규정을 위반하지 않았다고 본 것은 방송내용을 대상으로 하는 방송심의 및 행정법규인 심의규정 위반에 대한 제재조치에 형사상 명예훼손의 법리를 그대로 적용한 잘못이 있다. 향후 대상판결을 빌미로 방송사업자가 시청자가 제작한 역사 다큐멘터리 프로그램이라는 명분하에 정파를 달리하는 정치지도자에 대한 편향적이고 모욕적인 표현 방송프로그램에 대해 정당성을 주장할 수 있다는 우려가 제기된다.
This article is a critical review of the Supreme Court en banc Decision 2015Du49474 Decided November 21, 2019. Broadcast programs subject to deliberation are not deemed to be confined to news reports, and a review of broadcasts must take into consideration the distinctive characteristics of each medium, channel and program, and culture programs or entertainment programs must be governed by eased standards of review regarding objectivity, impartiality, and balance compared to news reports programs. Here, eased standard of review is related to not deciding whether to violate the Review Regulations but the severity of sanctions measures. Considering the contents of each broadcast in this case, there are problems with the Majority Opinion that judged both broadcasts did not violate the obligation to maintain objectivity, impartiality, and balance because they were historical documentary programs produced by viewers. Under the current broadcasting law adopting internal pluralism, the obligation of broadcasters to observe impartiality, balance, and objectivity takes precedence over the freedom of expression of broadcasters. Also, in interpreting the Review Regulations related to the obligation to respect the reputation of a decedent, the Majority Opinion directly borrows the legal doctrine regarding the constituent elements and justification of defamation of a decedent under the Criminal Act. In the future, there are concerns that a broadcaster may assert the legitimacy of a broadcast program that expresses a biased and insulting expression against political leaders of different factions under the pretext of being a historical documentary program produced by viewers based on this case.
