디지털 환경이 조성되면서 전통적인 저작권법의 영역은 급속도로 확장되어 ‘디지털 저작권’이라는 개념이 등장하였다. 초연결성으로 대표되는 디지털 환경은 저작권 영역을 확장했을 뿐 아니라, 저작권 침해의 영역을 범국가적으로 확대하였다. 본고는 저작권 침해 수사 관련 국내외 논문·보고서와 최신 기사를 바탕으로 다양한 저작권 침해 유형 중 해외에 서버를 둔 P2P 사이트를 통해 일어나는 저작권 침해에 초점을 맞추고, 저작권 침해 수사 시 국내외 공조체계의 문제점을 분석하여 국제공조 수사모델을 제시한다. 프로세스 측면에서는 국제공조 수사 시의 단계를 준비단계, 침해 발생 단계, 국내공조 단계, 국제공조 단계로 나누어 주관기관과 그 역할을 역설하고, 운영 방식 측면에서는 통합 실무기구를 중심으로 저작권 특사경의 권한 확대, 암호화폐 거래소와의 공조, 코리안데스크 설치 및 확대를 제안한다. 최근 지식재산 보호 정책협의회 개최, 유럽 사이버범죄협약 가입 추진 논의 등 저작권 보호를 위한 국제공조의 기반을 마련하고 있는 정부의 적극적인 움직임 속에서, 본고에서 제시한 모델은 저작권 침해 수사 시 국제공조가 원활하게 이루어질 수 있는 실효적 방안을 제시한다는 데에 의의가 있다. 저작권 침해 수사에 있어 원활한 국제공조는 저작권 침해자에 대한 처벌의 확실성을 높여 저작권 산업을 진흥하고 보호하는데 이바지할 수 있을 것이다.
As the digital realm expands, the concept of traditional copyright expands and new term called ‘Digital copyright’ appears. While the digital environment represented as ‘hyper-connectivity’ has had copyright develop, it has raised the possibility of copyright infringement. This paper is based on internal and external articles and up-to-date news related to ‘Copyright infringement at P2P sites based on overseas servers’ among the various types of copyright infringement. This paper brings up a problem about the cooperative investigation. We suggest an ‘copyright infringement investigation cooperation model’ in view of process and operation methods. First, we divided the international investigation assistance system into 4 steps that preparation phase, development phase, internal investigation phase, and external investigation phase. Second, we put emphasis on the establishment of ‘Copyright Investigation Practical Union’ that can help to expand copyright-specialized police’s authority, work together with the reliable cryptocurrency exchange, and install the ‘KoreanDesk’ for external investigation. In this trend that our government has tried to establish the union for international cooperative investigation, it is imperative to suggest some effective solutions for international investigation cooperation on copyright infringement. If this model is combined with government’s recent efforts for establishing international investigation cooperation, it helps to develop the copyright industry and protect the copyrights.
